My wife and i were walking back from a friends house last night along our
usual route which although has streetlights along it is quite a dark road.
All of a sudden my wife fell over and ended up screaming in pain. We did the
hospital run where she was x-rayed and told that she has broken her ankle
and that it was quite a nasty break. She has also scraped her other leg and
the toe on that leg is almost black.
What she had done is fallen into a hole in the paving where the council had
obviously taken the slabs up, piled them up and put some form of barriers
there (with no lights) which had either been blown down or kicked down by
the local yobs.
I went back there today to take some photo's and couldn't belive how unsafe
it looked.
We want to make a claim against the council obviously for compensation but
mostly out of anger for their complete lack of safety
awareness/acknowledgement.
My prime concern is that the slabs will be repaired tomorrow and the
barriers took away so that we can't prove where it was and it looks as
though it never happened.
Yes i do have the pictures and they do show exactly where it is but I'm
worried that they could say that the pictures weren't recent ones.
I really don't know where to go from here, should i start by calling a
typical 'no win- no fee' solicitors firm?
Should i call the council first to let them know about it?
Any feedback would be massively appreciated and I can send the photographs
via e-mail if it helps you to help me.
